Magazine ??? sure, why not !

Anne Julie’s

Dear Ms. Julie’s

JSP Corp. DBA (Jackie Shumaker Photography) is a Colorado image resource offering, among other things, licensing of stock photography image(s).  The image(s) are subject to all applicable federal and international copyright protection.  Jackie Shumaker Photography treats copyright infringement as a serious matter.  It has recently come to our attention that directly reproduces, adapts, displays, and/or distributes what we believe to be an unauthorized version of Jackie Shumaker Photography’s Image(s) of The Pepsi Center Denver CO (hereinafter, the “Image(s)”).  Please refer to the attached enclosure for further clarification.

You are probably aware of Copyright law. According to Copyright law, the burden is on the user to find out, before using the image(s), who owns the copyright to the images and obtain the necessary license (permission/authorization) in writing, for any use. Failure to do so constitutes a copyright infringement and the copyright owner is entitled to a punitive damage award of up to US $150,000.00 in addition to a monetary award for the usage and all attorney’s fees and legal costs. Physical possession of prints, slides or digital files does not grant ownership of our image(s) to any party and in order to legally use any of our image(s), a client needs to obtain a specific written license from Jackie Shumaker Photography that specifies in detail the rights granted and the fees due.

We are ready to believe that did not mean harm to our business by using our image(s) without authorization or payment, so we would appreciate if you could provide the following:

1. a complete list of all uses of our image(s). (names & dates of each and all publications, quantity printed of each publication, reprints, flyers, brochures, period of time and location on the web, etc.).

2. Explain to us how you came into possession of our image(s), and identify by name, address, email, and telephone number the person who gave you our image(s), or told you that you could use our image(s).

After comparing this information with the data we have collected ourselves, you will receive an invoice for the use. If you wish to continue using our image(s), please let us know. Otherwise, we would be grateful if you would immediately cease using our image(s) and discontinue to distribute any materials containing our image(s). This affects our current business and distributing copyrighted photos without authorization will increase your liability. This letter is being sent to you without prejudice as we are reserving all rights that we may have against you.

Thank you for your prompt attention to this matter.
Awaiting your reply by February 18th, 2008.
